German VAT (Umsatzsteuer / Mehrwertsteuer): Rates, Registration, and Filing

⚠️ Disclaimer: For general information only — not tax, financial, legal, or medical advice. Figures may be outdated or incorrect; tax rules change frequently. The short answer

Germany's value-added tax is legally called Umsatzsteuer (often labelled Mehrwertsteuer on receipts — same tax). The standard rate is 19%; a reduced 7% applies to essentials such as groceries, books, and newspapers. Businesses charge VAT on their sales, reclaim the VAT they paid on purchases (Vorsteuer, input tax), and remit the difference to the Finanzamt (local tax office). Small businesses under the Kleinunternehmerregelung thresholds can opt out of the whole system.

The two rates: 19% and 7%

19% — the standard rate on most goods and services, from electronics to restaurant meals. 7% — the reduced rate on groceries, books, newspapers, and public transport, among others. Unlike in the US, consumer prices in Germany already include VAT by law, so the shelf price is the price you pay.

Who charges VAT — and the small-business escape hatch

Anyone selling goods or services commercially counts as an entrepreneur (Unternehmer) for VAT purposes and must normally charge VAT. The exception is the Kleinunternehmerregelung (small-business rule): since January 1, 2025, businesses whose turnover was €25,000 or less last year and will be €100,000 or less this year may opt out — no VAT on invoices, no VAT returns. The trade-off: you also cannot reclaim input VAT (Vorsteuer) on your purchases. If your current-year turnover exceeds €100,000, the exemption ends immediately. The rule is optional — businesses with large startup purchases often voluntarily charge VAT precisely to reclaim the Vorsteuer.

Filing and paying: advance returns

VAT-registered businesses file advance returns (Umsatzsteuer-Voranmeldung) — monthly or quarterly depending on the previous year's VAT liability — plus one annual return (Umsatzsteuererklärung). Everything is filed electronically via ELSTER. Advance returns are generally due by the 10th of the following month (§18 UStG; a one-month permanent deadline extension is available on application), and missing them can trigger late-filing surcharges, so calendar them carefully.

Invoices and the VAT ID

A proper German invoice must show the seller's tax number or VAT ID (Umsatzsteuer-Identifikationsnummer, USt-IdNr), the VAT rate applied, and the VAT amount separately. Businesses trading with other EU countries need a USt-IdNr, which is issued by the Bundeszentralamt für Steuern (Federal Central Tax Office). Business-to-business sales to other EU member states are generally zero-rated under the reverse-charge mechanism.

Frequently asked questions

Is VAT included in German shelf prices?

Yes — by law, prices shown to consumers must include VAT. The 19% or 7% is already in the number on the tag.

What is the difference between Umsatzsteuer and Mehrwertsteuer?

There is none in practice. Umsatzsteuer is the legal term used in the tax code; Mehrwertsteuer is the everyday label you see on receipts and in conversation.

I'm a freelancer with under €25,000 turnover. Should I use the Kleinunternehmerregelung?

It depends on your customers. If you sell to consumers, skipping VAT keeps your prices simple and competitive. If you sell to businesses, they can reclaim your VAT anyway — so charging it costs them nothing and lets you reclaim Vorsteuer on your own expenses.

What happens if I exceed €100,000 mid-year under the Kleinunternehmerregelung?

The exemption ends immediately: you must start charging VAT on your invoices from that point and begin filing advance returns. Track your turnover monthly so the switch doesn't catch you by surprise.

Do I need a USt-IdNr if I only sell within Germany?

No. The USt-IdNr is only required for cross-border trade within the EU. Domestic-only businesses use their regular tax number (Steuernummer) on invoices.
