Freelancer vs. Trade Business in Germany: Taxes for the Self-Employed

⚠️ Disclaimer: For general information only — not tax, financial, legal, or medical advice. Figures may be outdated or incorrect; tax rules change frequently. Verify important decisions with the CRA/IRS or a qualified professional (for health topics, a licensed healthcare provider). You use this information at your own risk.
The short answer

Germany splits the self-employed into Freiberufler (liberal professions — IT, consulting, design, journalism, and similar independent work) and Gewerbe (commercial trade businesses). Freiberufler skip the trade registration but must still register with the Finanzamt (local tax office); a Gewerbe must register with the local trade office (Gewerbeamt) and pays trade tax (Gewerbesteuer) on top of income tax. Both pay income tax on profits under the same progressive brackets, and small turnovers can use the Kleinunternehmerregelung VAT exemption.

Freiberufler or Gewerbe — which are you?

Freiberufler (liberal professions). A legally defined catalogue — doctors, lawyers, engineers, architects, journalists, artists — plus comparable independent work such as IT consulting, design, and coaching. The perks: no trade registration and no trade tax. You still must notify the Finanzamt by filing the tax registration questionnaire (Fragebogen zur steuerlichen Erfassung), after which you receive your tax number (Steuernummer).

Gewerbe (trade / commercial business). Everything commercial that is not a liberal profession: shops, e-commerce, crafts, agencies. You must register with the Gewerbeamt (Gewerbeanmeldung, trade registration) before starting, and you become liable for trade tax (Gewerbesteuer) — a municipal tax on business profits charged on top of income tax. When in doubt about your status, the Finanzamt decides — clarify it before you start, not after.

The taxes you will actually pay

Income tax (Einkommensteuer). Both groups pay it on profit — revenue minus deductible expenses — under the same progressive brackets (2026: 0% up to €12,348, then 14% rising to 42% up to €69,878, 42% up to €277,825, 45% above). Trade tax (Gewerbesteuer) — Gewerbe only, with rates varying by municipality. VAT (Umsatzsteuer) — 19% standard / 7% reduced, unless you qualify for the Kleinunternehmerregelung (prior-year turnover ≤€25,000 and current year ≤€100,000). Once the Finanzamt has assessed you, expect quarterly advance income-tax payments (Vorauszahlungen) during the year.

Bookkeeping: EÜR for most

Most small self-employed businesses use the cash-basis profit calculation (Einnahmenüberschussrechnung, EÜR) instead of full double-entry accounting (Bilanz) — simpler, and filed with the annual return via ELSTER. Whatever method you use, keep every receipt: German tax audits run on documentation.

Practical startup checklist

  1. Clarify whether you are Freiberufler or Gewerbe (the Finanzamt decides in doubtful cases).
  2. Register: file the Fragebogen zur steuerlichen Erfassung with the Finanzamt as a Freiberufler; complete the Gewerbeanmeldung at the Gewerbeamt as a Gewerbe.
  3. Decide between the Kleinunternehmerregelung (VAT exemption) and standard VAT taxation.
  4. Open a separate bank account and track income and expenses from day one.
  5. Budget for quarterly Vorauszahlungen once the first assessment arrives.

Frequently asked questions

I'm a software developer. Freiberufler or Gewerbe?

Typically Freiberufler as an independent IT professional — but if the activity shifts toward selling standardized software products as a business, it can tip into Gewerbe. The Finanzamt makes the final call on your specific facts.

Do I need a German address to register?

Generally yes — registration (both the Anmeldung and the tax registration) is tied to a German address. Clarify your setup with the Finanzamt before invoicing.

Can I switch from the Kleinunternehmerregelung to standard VAT later?

Yes, voluntary standard taxation is possible — but the choice binds you for at least five calendar years (§19 UStG), so decide with your expected turnover in mind.

Do freelancers pay trade tax?

No. Gewerbesteuer applies only to a Gewerbe. This is one of the main financial reasons the Freiberufler classification matters.

What about social insurance as a self-employed person?

The self-employed are generally outside statutory pension and unemployment insurance, but health insurance is mandatory in Germany — including for the self-employed. Artists and writers may qualify for the artists' social fund (Künstlersozialkasse), which subsidizes contributions.

Do I need an accountant?

Not legally required for an EÜR-based business, but most newcomers hire a Steuerberater (tax advisor) for the first year — German bookkeeping rules and the Fragebogen are unforgiving of beginner mistakes.
