The short answer
South African permanent residence (PR) is applied for under Sections 26 and 27 of the Immigration Act, each with its own qualifying route. Citizenship by naturalisation comes later: you must have held PR for 5 years of continuous residence before you can apply. From first arrival to a South African passport, the realistic timeline is roughly a decade.
PR routes (Immigration Act)
Section 26(a): 5 years of continuous work on a qualifying work visa.
Section 26(b): spouse of a South African citizen or permanent resident for 5 years.
Section 26(c): child (under 21) of a citizen or permanent resident.
Section 26(d): child (over 21) of a citizen, financially dependent.
Section 27(b): foreigners with 5 years of post-qualification experience in a critical-skills occupation plus a permanent employment contract — the fast track that can bypass the 5-year visa-waiting period.
Section 27(c): business owners with a qualifying investment in an operating business.
Section 27(e/f): retirees with sufficient means; relatives of citizens/PRs within the first step of kinship.
Section 27(g): net worth route (historically around R12 million, with a fee component).
The application process
Apply via VFS Global (inside South Africa) or a mission abroad, using the DHA PR checklist for your category.
Expect a long paper trail: police clearances, medicals, proof of continuous residence/employment, marriage certificates where relevant.
Processing is notoriously slow — historically 1–4+ years, with a well-documented DHA backlog. The 2024–2026 reforms (including an expedited/points-based push) aim to clear it, but apply early and keep certified copies of everything.
Once granted, PR is indefinite but lapses if you are outside South Africa for 3+ continuous years.
Citizenship by naturalisation
Requirement: 5 years of continuous residence as a permanent resident (Citizenship Act, Section 5), good character, adequate knowledge of an official language, and intention to continue residing in South Africa.
Dual citizenship: South Africa allows it in principle, but citizens who acquire another nationality as adults must apply to the DHA to retain their South African citizenship before acquiring the new one — miss this step and you can automatically lose SA citizenship.
Applications are lodged with DHA; timelines are long (years, not months).
Frequently asked questions
Does time on a study visa count toward PR?
Not directly — the standard work route counts 5 years on a work visa (26(a)), not student time.
Can my PR be revoked?
PR can be withdrawn for fraud, certain criminal convictions, or 3+ years of continuous absence. Keep your affairs clean and visit regularly.
Is the 27(b) "fast track" really faster?
It skips the 5-year visa wait, but you still need 5 years of post-qualification experience and a permanent contract — and DHA processing itself remains slow.
What about my children born in South Africa?
Birth in South Africa alone does not confer citizenship (no unconditional jus soli). Children of PR holders/citizens have their own routes — check the current Citizenship Act provisions.
