7 Immigration Pitfalls That Derail South Africa Moves (and How to Avoid Them)

The short answer
Most South Africa immigration disasters are not rejections — they are avoidable process mistakes. These seven come up again and again in expat forums and with immigration practitioners: learn them before you start.
1. Assuming you can switch visas inside the country
As a rule, you cannot change from a visitor's visa to a work or study visa while inside South Africa. Arriving on a tourist stamp to "sort it out locally" usually ends in a wasted trip. Apply from outside.
2. Letting a visa lapse while waiting
Renewals must be lodged at least 60 days before expiry. An expired visa means unlawful presence, which can trigger bans on re-entry. Set a calendar reminder 90 days out — then act on it.
3. Stale documents
Police clearances and medical/radiological reports must be under 6 months old at submission. Applicants regularly get refused because a clearance aged out during a slow SAQA or professional-body process. Sequence your paperwork so clearances are the last thing you obtain.
4. Starting SAQA too late
SAQA qualification evaluation (12–18 weeks) is the critical path for critical-skills and general work visas. Starting it after everything else is ready adds months of dead time. Begin SAQA on day one.
5. Working on the wrong visa
Working on a visitor's visa (including remote work for a South African employer without a work visa) is illegal. Note the asymmetry: remote work for a foreign employer is covered by the remote work visa; remote work for a local employer requires a proper work visa.
6. Trusting unregistered "agents"
South Africa has a persistent problem with fraudulent immigration agents. Anyone promising guaranteed visas, "special DHA contacts" or results in days is a red flag. Use registered immigration practitioners, get receipts for everything, and never hand over your passport without a paper trail.
7. Forgetting the tax angle
A work visa makes you likely tax-resident (and liable for SARS registration). Remote workers on the remote work visa face genuinely murky tax treatment — get tax advice before you arrive, not after SARS comes asking. (See our tax residency and SARS tax number guides.)
Frequently asked questions
I overstayed by a few days. How bad is it?
Overstays are taken seriously and can lead to being declared undesirable (re-entry bans of 1–5 years depending on length). If it happens, get legal advice immediately — do not just try to fly out quietly.
Can I appeal a refusal?
Yes — refusals can be appealed to the DHA within the prescribed window. Appeals are slow; fixing the underlying document problem and re-applying is sometimes faster.
My passport expires soon. Does it matter?
Yes. Visas are not issued beyond passport validity, and many categories require 30+ days beyond your intended stay. Renew the passport first.
Is the backlog really as bad as people say?
It has been severe (years for some PR categories), though 2024–2026 reforms and backlog-clearance projects are improving things. Treat official timelines as minimums.
