Freelancer and Self-Employed Tax in South Africa: Provisional Tax Explained

⚠️ Disclaimer: For general information only — not tax, financial, legal, or medical advice. Figures may be outdated or incorrect; tax rules change frequently. Verify important decisions with the CRA/IRS or a qualified professional (for health topics, a licensed healthcare provider). You use this information at your own risk.
The short answer

If you freelance or run your own business in South Africa, there is no employer to deduct PAYE — you pay through the provisional tax system instead. Provisional taxpayers make two estimated payments per tax year (a third "top-up" payment is allowed), file an annual return reconciling everything, and handle their own VAT registration, record-keeping and retirement planning.

The provisional tax cycle

  • First payment: due 31 August (six months into the tax year) — at least half of your estimated total tax for the year.
  • Second payment: due 28/29 February (year-end) — enough to bring the year's total paid to at least 80% (90% if your taxable income exceeds R1 million) of the final liability, or face underestimation penalties.
  • Third (top-up) payment: voluntary, due 30 September after year-end — a last chance to close any gap without penalties.
  • Annual return: file on eFiling (usually by end of January following the tax year for provisional taxpayers) with an IRP6 for each payment.

Registration and admin

  • Register as a provisional taxpayer with SARS (via eFiling) as soon as you start trading — and register for income tax within 60 days of becoming liable.
  • VAT: mandatory registration above R1 million turnover in 12 months; voluntary above R50,000. Many freelancers serving corporate clients register voluntarily so clients can claim input tax.
  • UIF/SDL: if you hire employees, you must register as an employer for PAYE, UIF (1% + 1%) and the Skills Development Levy (1% of payroll above the threshold).

Deductions freelancers commonly claim

  • Home office: a portion of rent/bond interest, utilities and maintenance, apportioned by floor area used exclusively for work.
  • Travel: business kilometres at the SARS rate (keep a logbook — SARS audits these).
  • Equipment: computers, phones and furniture — depreciation or the small-asset write-off rules.
  • Professional fees: accounting, legal, professional body subscriptions.
  • Retirement: contributions up to 27.5% of the greater of remuneration or taxable income, capped at R350,000 per year.

Frequently asked questions

How is this different from being an employee?

Employees have PAYE deducted monthly and mostly just file a return. Freelancers estimate and prepay their own tax, manage VAT, and get no employer benefits (no paid leave, no employer UIF top-ups) — price your rates accordingly.

What if I underestimate my provisional payments?

SARS charges an underestimation penalty (a percentage of the shortfall) plus interest. When in doubt, pay slightly more in the second payment — overpayments are refunded with interest.

Do foreign clients change anything?

Services exported outside South Africa are generally zero-rated for VAT (0%), which is why many freelancers register voluntarily. Income from foreign clients is still taxable if you are a South African tax resident.

Should I operate as a sole proprietor or a company?

Sole proprietor is simplest to start (taxed at personal rates). A private company pays a flat 27% corporate tax but adds admin (annual returns, separate accounting). Many freelancers start as sole proprietors and incorporate once income is consistently high — get professional advice before deciding.
