The short answer

If you work for yourself in Brazil, your tax life revolves around one question: which regime fits your revenue. The short answer is that most solo freelancers start as a MEI (Microempreendedor Individual) — a simplified regime with a single low monthly payment — as long as annual revenue stays at or under R$81,000 (the 2026 cap, unchanged since 2018). Earn more, hire staff, or work in an excluded profession, and you move up to Simples Nacional or the regular system; individuals receiving foreign income directly (no company) declare it monthly through carnê-leão.

MEI: the solo freelancer's default

MEI is Brazil's micro-entrepreneur regime for one-person businesses. The essentials:

  • Revenue cap: R$81,000/year. If you open mid-year, the cap is proportional: R$6,750 per month of activity, including the opening month. Proposals to raise the cap (figures of R$110,000–R$140,000 have been discussed) are still bills in Congress — not in force in 2026.
  • One monthly payment (DAS). A single fixed monthly slip covers INSS (social security), ICMS/ISS and a small federal component — far simpler than separate filings. Amounts are modest, roughly R$80–90/month depending on activity [to verify the current year's value].
  • One employee allowed. You may hire a single employee at the minimum wage [to verify current terms].
  • Overshooting the cap. Up to 20% over (R$97,200) you pay a supplementary DAS on the excess and move to Microempresa status the following year; more than 20% over and the disqualification is retroactive to the start of the year, with back taxes as a Microempresa.

MEI also files a simple annual revenue declaration (DASN-SIMEI) each year [deadline May 31 of the following year — to verify], separate from personal income tax.

When MEI doesn't fit: Simples Nacional and beyond

If your revenue exceeds the MEI cap, your activity is excluded from MEI, or you need partners or more employees, the next step is usually Simples Nacional — a simplified regime for small businesses (Microempresa/EPP) with a single monthly payment (also via DAS) at progressive rates by revenue bracket and activity. Larger or more complex operations fall under Lucro Presumido or Lucro Real, where an accountant is essentially mandatory.

Carnê-leão: for individuals paid from abroad

If you are a tax-resident individual receiving income from foreign sources directly — say, freelance clients abroad paying your personal account, with no Brazilian company involved — you generally declare it month by month through carnê-leão and pay the tax via DARF by the last business day of the following month. This monthly advance then feeds into your annual DIRPF return. Rates follow the progressive monthly table — which, for 2026 income, means the new R$5,000 exemption band applies.

A practical decision path

  1. Just starting, low revenue, eligible activity → MEI. Register online via the government's MEI portal (Portal do Empreendedor on gov.br).
  2. Growing past R$81,000/year → Simples Nacional as a Microempresa.
  3. Foreign clients paying you personally → carnê-leão monthly, plus the annual DIRPF.

Frequently asked questions

Q: I'm a foreigner on a temporary visa. Can I register as MEI?

A: Generally you need a CPF and regular immigration status; permanent-visa holders have the fewest obstacles. Temporary-visa holders should confirm eligibility on the portal or with an accountant before registering .

Q: Does MEI income count toward the personal income tax exemption?

A: MEI's fixed DAS payment is separate from personal income tax, but the income you draw from the business still flows into your personal tax picture — the annual DASN-SIMEI and your DIRPF are linked [to verify details].

Q: Can a MEI issue invoices (nota fiscal)?

A: Yes — MEIs can and generally must issue notas fiscais for sales to companies; requirements for sales to individuals vary .

Q: What if my revenue is seasonal and one month spikes?

A: MEI's cap is annual (R$81,000), not monthly — a single strong month is fine as long as the yearly total stays within the cap.
