EB-5 Fees More Than Double on November 30, 2026: The New Fee Schedule

The short answer

On September 30, 2026, DHS published a final rule — 91 Federal Register 61940 — overhauling USCIS fees for the EB-5 immigrant investor program. The new fees take effect November 30, 2026, and the headline numbers are stark: the main investor petition fee more than doubles. If you are planning an EB-5 filing, the postmark date on your application now has a direct dollar value. Here is the full schedule, what changed, and how to handle the deadline.

The investor-facing fees

FilingCurrent feeNew fee (Nov 30, 2026)
Form I-526, standalone investor petition$3,675$7,615
Form I-526E, regional center investor — initial$3,675$7,850
Form I-526E — amendment$3,675$7,775
Form I-527, amendment to legacy Form I-526Not previously available$10,330
Form I-829, petition to remove conditions$3,750$5,000

Three details are easy to misread:

  • The $75 technology fee is already included in the I-526 and initial I-526E figures above — it is not an extra charge on top.
  • The Integrity Fund fee is paid separately. The investor Integrity Fund fee rises from $1,000 to $1,100, so a regional center investor filing an initial I-526E will pay $8,950 in total once the rule takes effect, versus $4,675 today.
  • Form I-527 is brand new. It is for certain investors who must amend older I-526 petitions, at $10,330.

DHS estimates the schedule raises EB-5 fees by roughly 70.7 percent on a weighted average across about 16,600 filings a year.

Regional center fees — the bigger shock

Investor petitions get the headlines, but regional center operators face even steeper increases:

FilingCurrent feeNew fee (Nov 30, 2026)
Form I-956, initial regional center designation$17,795$44,115
Form I-956, amendment$17,795$9,835
Form I-956F, project application or amendment$17,795$42,675
Form I-956G, annual statement/amendment/supplement$3,035$2,165
Form I-956H, bona fides of persons involved$0$65
Form I-956K, promoter registration$0$2,165

Regional center annual Integrity Fund fees rise to $11,000 (20 or fewer investors) or $22,000 (more than 20 investors).

The hard deadline: November 30, 2026

USCIS will apply the new fees to all applications postmarked on or after November 30, 2026. Petitions postmarked before that date may use the existing fees. Practical implications:

  • Filing in November? If your petition is ready, there is a clear financial incentive to file before the deadline — the difference on an I-526E is $4,175 in petition fees alone.
  • Do not rush a defective filing to beat the clock. A rejected or deficient petition costs far more than the fee difference. If the petition is not genuinely ready, filing early is a false economy.
  • Confirm the exact amount with USCIS resources before submitting. Fee tables, the $75 technology fee inclusion, and Integrity Fund add-ons make the arithmetic error-prone. Double-check the total on uscis.gov.
  • Investment thresholds are unchanged. The baseline investment amounts remain $800,000 for targeted employment areas and infrastructure projects and $1.05 million for standard investments — this rule changes fees, not investment minimums.

Why USCIS says this is happening

USCIS is largely funded by applicant fees rather than taxes. The agency says the new schedule achieves full cost recovery for EB-5 program administration, funds statutory processing-time targets, and pays for expanded integrity work — audits, site visits, and fraud detection — required under the EB-5 Reform and Integrity Act of 2022. This rule was written under that Act's authority, which DHS notes gives it firmer legal footing than the fee rule it replaces (the prior amounts had been reinstated only after a November 2025 court order).
