Do I need to tell IRCC if someone helps with my immigration application?

Short answer: if that person acts as your representative — paid or unpaid — yes, you must disclose them to IRCC on the Use of a Representative form (IMM 5476). Failing to declare someone acting on your behalf can be treated as misrepresentation, which can get your application refused and bar you from Canada for five years.

This applies whether the helper is a paid immigration consultant or a friend or family member who fills in forms, communicates with IRCC, or submits documents for you. Someone who merely checks your application status for you is not a representative — IRCC has a separate form for that, the Authority to Release Personal Information to a Designated Individual (IMM 5475).

Who counts as a "representative"?

IRCC draws the line at people who act on your behalf in your immigration process: completing your forms, advising you on what to submit, uploading documents, or contacting IRCC for you. That can be:

  • a paid immigration consultant or lawyer you hired, or
  • an unpaid helper — a friend, relative, or community volunteer who does any of the above for you.

You can appoint one representative per application at a time. If you have already submitted your application without declaring them, you can send the completed IMM 5476 to IRCC afterwards through IRCC's web form.

What happens if you don't declare them?

IRCC may consider an undeclared representative a form of misrepresentation. Consequences of misrepresentation are among the harshest in Canadian immigration law:

  • your application can be refused;
  • you can be barred from entering Canada for at least five years;
  • you can get a permanent record of fraud with IRCC;
  • you can lose permanent resident or citizenship status obtained through it;
  • you can face criminal charges or removal from Canada.

IRCC's own help centre puts it bluntly: representatives who advise you to provide false information are breaking the law, and giving false information — even if someone else prepared it — is your responsibility.

The representative doesn't protect you from bad advice

A common trap: a paid consultant or "helper" submits something inaccurate, and the applicant assumes the blame sits with the preparer. It doesn't. You sign the forms, and the declarations on them make you legally accountable for everything submitted. If your representative told you to provide false information or documents, that representative is breaking the law — but your application can still be refused and you can still face a ban.

If you suspect misconduct: gather your copies of the submitted forms, emails, receipts, and your retainer agreement; ask the consultant for an explanation and a copy of your file; and get independent advice from a licensed professional. If the person is a paid immigration consultant, you can also file a complaint with the College of Immigration and Citizenship Consultants.

Practical checklist before you submit

  1. Decide who, if anyone, is acting as your representative — not just who you paid, but anyone preparing or submitting material on your behalf.
  2. Complete IMM 5476 (Use of a Representative) and include it with your application, or send it via IRCC's web form if you've already applied.
  3. If someone only checks your status, use IMM 5475 instead — that does not make them a representative.
  4. Keep your own copies of everything submitted, and read every form before it goes in. Never sign a blank or unread form.

Preguntas frecuentes

My friend just helped me translate and fill in the forms for free. Is that a representative?

If they completed the forms or will communicate with IRCC on your behalf, treat them as a representative and declare them on IMM 5476. Translation help alone is a grey area, but anything beyond that — filling, submitting, corresponding — clearly counts.

Can I declare a representative after I've already submitted?

Yes. If you've already applied, send the completed IMM 5476 to IRCC through its web form.

Does declaring a representative slow down my application?

No. IRCC's help centre states that using a representative does not get your case processed more quickly — but failing to declare one can get it refused.

What if my consultant submitted wrong information without telling me?

You are still legally responsible for what was submitted. If the decision is still pending, correct it quickly through IRCC's web form with supporting documents, keep all your evidence, and seek independent licensed advice immediately. Timing matters — act fast.
